Appointing a Lasting Power of Attorney
- there are two types of Attorney you can appoint. One to support with financial decisions, and one for personal welfare. For people where there are reasons to doubt capacity to appoint an attorney, Help For Care are able to complete a Mental Capacity Assessment for both decisions and sign as Certificate Provider on the application form.
Care and Support decisions
- when families are struggling to know what support is best for their loved one, a Mental Capacity Assessment can really help to either confirm the indivdual can make their own decisions, and therefore take their own risks, or to ensure care is provided in a person's best interest where they're not able to make this decision for themselves.
Selling their property
- Help For Care work alongside Solicitors who have been instructed to sell a property for someone where their capacity to decide this for themselves is being questioned. Solicitors need to confirm if they're taking instructions from the individual or from the Attorney, and our assessments helps to clarify this to ensure there is no delay in the sale.
Testamentary Capacity (writing of a will)
- it's vital, when writing a will, to ensure that the individual is making a capacitous decision, to ensure their wishes are adhered to and to prevent challenges at a time when families are grieving for their loved one. These assessments have to follow the Banks v Goodfellow test, and our assessors are competent in completely high quality assessments, that would stand up to legal challenge.
Gifting money
- at times people with mental capacity choose to gift money to friends or family, and it's essential that they are able to continue doing this, alongside relevant financial advice, whilst they're still able. There are many times where Financial Advisors or Solicitors are unsure of the person's ability to make this decision, and Help For Care will ensure all support avenues are explored, to enable them to make this deicision if they can.
