How Help for Care can help

Many Adults need their care provided in a way that restricts their rights and freedoms, in order to keep them safe. Article 5 of the Human Rights Act - the right to liberty - ensures no one person is deprived of their liberty except in very certain circumstances, as prescribed by law.

Deprivation of Liberty Safeguards (DoLS)

Legislation to deprive a person of their liberty in a Care Home or Hospital. in their best interest, if certain criteria are met.  Help For Care has Qualified Best Interest Assessors to undertake these assessments and experience in providing advocacy as a Relevant Persons Representative (RPR) to ensure a person's care arrangements remain in their Best Interest and to support a person to have their DoLS reviewed, or to support an appeal of their deprivation in the Court of Protection. 

Deprivation of Liberty, whilst living in the community

This is authorised by the Court of Protection and Help For Care are experienced in providing advocacy under the Rule 1.2 Representative, ensuring these arrangements remain in the persons best interest and that care is provided in the least restrictive way possible.  A really important role that opens up an avenue for these arrangements to be revisted by the Court of Protection if required.
